Does SB 1256 Imperil Our Communities?

Request your representatives oppose SB 1256 as it could set a precedent that undermines fire safety and evacuation-related regulations. This unconscionable bill appears to be an attempt to use legislation to defeat a lawsuit by the Elfin Forest/ Harmony Grove Town Council against the approval of new development in a high fire hazard area.

The bill appears to be focused on a recent lawsuit filed by the Elfin Forest - Harmony Grove local town council against Harmony Grove Village South (HGVS).

Mother Nature issued a warning that this community will always be in peril for wildfires.  In 2014, it took residents over an hour to evacuate the box canyon – even before the 750-unit development was built.

The 2014 Coco Fire destroyed 30+ homes and produced a dire evacuation scenario. Several years later, the San Diego County Board of Supervisors (SD BOS) approved and built the 750-unit Harmony Grove Village.

Recently, the SD BOS overturned a judges’ order and approved a 450-unit development - Harmony Grove Village South - without the required two evacuation roads that meet the State Minimum Firesafe Regulations (FSR). The decision ignored technical “emergency traffic evacuation” studies; and substantive evidence exists that the proposed mitigation measures DO NOT have the “Same Practical Effect” in terms of firefighter and citizen safety as required by the FSR. 

The Elfin Forest/Harmony Grove Town Council sued a second time - given a faulty approval process and the public safety impacts: This decision puts the existing community plus the residents of the 1,200 new homes at risk for community burn over.
