Communities Challenge Land Use Decisions in Court

Plaintiffs in multiple California counties have challenged land use decisions that threaten public safety.

Lake County Decision: In 2024, Judge J. David Markham wrote: 

“The additional people competing for the same limited routes can cause congestion and delay in evacuation, resulting in increased wildfire-related deaths.”

In Los Angeles County, Superior Court Judge: Hon. Mitchell L. Beckloff stated:

”…as the EIR’s mitigation discussion is flawed, the County improperly adopted a statement of overriding considerations; and (d) the EIR’s conclusion wildfire risk impacts outside of the Project site will be reduced to less than significant is not supported by any analysis.”
